The TCI Telecommunications Fee Structure

Citation
1. These Regulations may be cited as the Telecommunications Fee Structure Regulations 2006, and shall come into operation on __.

Interpretation
2. (1) In these Regulations unless the context otherwise requires --
“Ordinance” means the Telecommunications Ordinance, 2004.
“Gross” means revenue of reporting year received by, or due to the Licensee and its affiliates, from whatever source derived before any deductions for expenses, discounts, returns, or offsets of any kind, save and except domestic interconnection payments and those pass through taxes or charges for and on behalf of the Government of the Turks and Caicos Islands.
(2) Unless otherwise specified, terms used in these Regulations shall have the meanings assigned to them under the Ordinance.

Fee Structure
3. (1) A person applying under the Ordinance for an individual license will be required to pay (a) the application fee as set out in Schedule 1; and
(b) on grant of the license the fee set out in the first column under the heading “License Fees” in Schedule 1; and
(c) at the end of the first year the fee set out in the second column under the heading “License Fees” in Schedule 1; and
(d) annually after the first year the fee set out in the third column under the heading “License Fees” in Schedule 1.
(2) A person applying under the Ordinance for a class license will be required to pay (a) the application fee as set out in Schedule 2; and
(b) on grant of a class license the fee set out in the first column under the heading “License Fees” in Schedule 2; and
(c) at the end of the first year the fee set out in the second column under the heading “License Fees” in Schedule 2; and
(d) annually the fee set out in the third column under the heading “License Fees” in Schedule 2.
(3) A person applying under the Ordinance for a frequency authorisation will be required to pay the fees set out in Schedule 3.
(4) Fees not covered under sub-regulations (1), (2) or (3) which may be applicable to a licensee shall be paid annually by the licensee in accordance with the fees listed in Schedule 4.

Payment of fees 4. (1) An application fee payable pursuant to these Regulations is not refundable and shall accompany the application for a spectrum licence.
(2) An initial fee payable pursuant to these Regulations shall be paid within two weeks of the licensee being informed in writing of the grant of the spectrum licensee and all further fees shall be paid as specified by the Commission upon notification of being granted the spectrum licence.
(3) An annual fee payable pursuant to these Regulations shall be paid on the anniversary date of the grant of the spectrum licence.
