These Regulations may be cited as the Telecommunication (Administrative Procedures) Regulations 2008.

Regulations made by the Governor in Council under section 64 of the Telecommunications Ordinance 2004

This document describes the approach to be followed by the Commission in implementing a spectrum plan for the islands, including a comprehensive public consultation process to establish the frequency plan for the nation.

This regulation sets out the rules to be followed by all licensed network operators to ensure that calls from users on one network can be seamlessly passed to users on other networks. The rules apply in particular to Cable & Wireless, the largest incumbent operator which therefore has special obligations to ensure that they do not take advantage of their dominant position in the marketplace to deter or complicate the entrance of new operators who require interconnection with the larger network.

These Regulations may be cited as the Telecommunications and Frequency Licensing Regulations. These Regulations, made by the Governor pursuant to sections 11, 32 and 38 of the Ordinance, apply to carrier licences, for the ownership and operation of telecommunications networks, to service provider licences, for the provision of public telecommunications services, to other licences, for the provision of other telecommunications services, to special licences and spectrum/ licences.

The numbering scheme for public telecommunications networks and public telecommunications services in the Turks and Caicos Islands shall conform to the NANP, except to the extent modified by the Numbering Plan and these Regulations.

This document sets out the criteria and formulas to be applied to an incentive form of pricing controls on services offered by Cable and Wireless and any other operators who are found to be dominant in their areas of operation.
